
Regulation (EU) 2023/1542 on batteries and waste batteries (also known as the Battery Regulation) contains, in Article 85, an obligation for contracting authorities when procuring batteries or products containing batteries. This obligation mandates to take account of the environmental impacts of batteries over their life-cycle with a view to ensuring that the impacts of the batteries procured are kept to a minimum.
Particularly, Article 85.2 refers to batteries, or products containing batteries, that fall within the scope of Articles 7 to 10. It mandates that any procurement procedure carried out by contracting authorities for the purchase of these products shall refer in its technical specifications and award criteria to the provisions that the Commission will establish. This will ensure that a product is chosen among those with significantly lower environmental impacts over its life-cycle.
Article 85.3 stipulates that the Commission shall adopt delegated acts to establish award criteria for procurement procedures for batteries, or products containing batteries, based on the sustainability requirements laid down in Articles 7 to 10.
The main objective of this task is to support the Commission in the development of Green Public Procurement (GPP) criteria for electric vehicle (EV) batteries, in line with the requirements set out in Articles 7 to 10 of the Battery Regulation, with a view to their adoption as a delegated act.
